In the past the membership in supervisory and advisory boards of stock corporations was often understood as voluntary position. These times are over since the implementation of the Law on the Supervision and Transparency in Business Sector (Gesetzes zur Verbesserung der Kontrolle und Transparenz von Unternehmen - KonTraG) in 1998.

The present-day discussion over corporate governance, the comparisons to supervisory boards of other legal systems and the spectacular company collapses which evoked harsh criticism of the supervisory work of supervisory boards point at the position, controlling possibilities and limits of such committees. Liability law-related consequences, the knowledge of the basic powers and obligations of the boards, as well as the insurance risk cover trigger an even higher demand for advisory services.
