Arbitration/Mediation


Anybody who is not willing to accept the duration and publicity of civil actions before state courts can usually decide for one of the alternative dispute resolution (ADR) methods: arbitration court.

Whether this option is possible or not depends to a large extent on whether the (alternative) competence of an arbitration court has been arranged effectively before a conflict arises. If so, it is imperative that the arbitrator or the members of an arbitration court have the necessary knowledge and apply it accordingly. It is thus advisable to make a binding arbitration agreement in advance, e.g. when signing an important purchase contract. However, ADR services can be utilized at any stage of a dispute in order to reach a consensual agreement that will accommodate the needs and interests of all.
